Slip-and-Fall Accidents in Wilmington

AS ALWAYS WITH OUR CLIENTS THERE IS NO fees and NO costs unless there is a recovery in your case!

L. Vincent Ramunno, managing partner of Ramunno & Ramunno Law Offices, takes great pride in our success at winning slip and fall and trip and fall claims, (sometimes referred to as “Premise Liability claims”) both at trial and before trial. While many law offices are afraid of taking slip and fall cases our office not only takes them, we enjoy litigating them. Some law offices are easily pushed around and either don’t want to take these cases or will take them but are afraid, or even unwilling, to file suit on them.

The lawyers at Ramunno Law Offices have not only won at trial on slip and fall cases, but won big. We have secured millions of dollars on slip and fall and /or trip and fall cases. We have represented literally thousands of slip and fall and /or trip and fall victims and we have enhanced knowledge on how to win these cases. We also know, from many years of handling them, what tactics the insurance companies and their lawyers are going to use and, most importantly, we know how to deal with these tactics. For instance, insurance companies sometimes will refuse to offer anything on slip and fall cases, hoping that if it goes to trial, a jury will find in their favor (not based on injuries, but rather based on the insurance companies standard strategy of blaming the victim.)

The way that works is, the insurance lawyer will often argue, you slipped and fell on ice, you should of seen it, you slipped and fell on water in the aisle of Wal-Mart, etc, you should of seen it. However, a smart and capable injury lawyer, through a combination of aggressive research and case development and thorough discovery, usually by depositions of the defendant’s employees, can generally neutralize this strategy. Our office not only makes sure to do this, but because we are not afraid to file suit on slip and fall or trip and fall cases, insurance companies know this, and because of this, they are more likely to offer money to settle the case before filing suit is even necessary. In addition, because of our track record of winning these cases, insurances companies are more likely to offer more money to our clients than they would if that client was with a different law office.

Success Leads to More Success

The lawyers at Ramunno Law Offices have not only won at trial on slip and fall cases, but won big. We have represented literally thousands of slip and fall and /or trip and fall victims and have enhanced knowledge on how to win these cases. We also know, from many years of handling them, what tactics the insurance companies and their lawyers are going to use and, most importantly, we know how to deal with these tactics.

For instance, in one lawsuit, Food Lion (who in the personal injury industry is notorious for trying to deny valid claims), offered a low amount on a straight forward slip and fall case, involving our client slipping on wet liquid that because of their negligence was in their aisle and hadn’t been cleaned up or even spotted by an employee of the defendant. Lawrence Ramunno took it to trial, and won, obtaining a verdict that was many times greater than their offer.

Why Stores Refuse to Hire Enough Employees, Jeopardizes Their Customer: To Increase Their Profits!

Defendants, especially stores that sell products to customers (which are referred to as “business invitees”) have a duty to keep their property safe, they have a duty to inspect their aisles for wet liquids on the ground and/or foreign objects, such as a broken egg or a banana peel, that could cause someone to slip and injure themselves. Unfortunately, many make a business decision, to save money by not hiring an adequate amount of employees. With an inadequate amount of employees little or no effort is made to monitor the safety of their stores for their customers. Inevitably, people get hurt due to this.

Ramunno Law has represented people who suffered fractured bones, including fractured wrists and fractured hips, due to slip and fall and/or trip and fall incidents. Ramunno Law has also represented people who suffered severe spine injuries, requiring surgery to their lumbar spines due to these companies’ negligence and indifference. We have also represented many clients whose injuries were not as severe, but nonetheless, very damaging to our clients’ quality of life and requiring many months, if not a year or more, of ongoing therapy, injections, etc. Generally, slip and fall and trip and fall cases can cause severe injuries, but some of our clients have been luckier and suffered injuries that were not as severe, and that only required say five or six months of therapy. Regardless of the extent of the injury, Ramunno Law takes every slip and fall and trip and fall case we accept seriously and goes all out to get top dollar for our clients. We start with thorough investigation of what happened, looking to prove the defendant’s negligence and also looking to see if other companies are partially to blame and if so, we include them in our settlement efforts and lawsuits.

We feel that these injuries will eventually start to decrease, if and when defendants are hit with jury verdicts that pack such a hard punch (via very large verdicts), that their intentional understaffing for financial gain is no longer going to bring a profit, but rather, will bring a financial loss. Although the defendants generally do not care, because the insurance companies are responsible for paying these injury claims several things will help if the jury verdicts are consistently high enough. For instance, if they are consistently at 5x or greater of what the medical bills are.

One, the insurance companies will start to insist that the understaffing stops if they are to renew the insurance policies. Two, the insurance companies might deter this understaffing by increasing the cost of these insurance policies. Three, many big retailers are self insured, although it varies from year to year, many, such as Wal-Mart, Pathmark, Home Depot, and others, are or have been self-insured, meaning they have no insurance coverage to fall back on. The lawyers at Ramunno and Ramunno have never seen a small, family owned store, for instance a deli or a gas station not carry insurance. The enormous, multi-national chain stores sometimes carry no insurance for slip and falls and trip and falls.
