So far, the evidence shows that Train 188 was travelling at 106 miles per hour as it entered the Frankford Junction which is near Frankford Avenue and Wheatsheaf Lane. This speed is outrageously excessive considering there is a 50 miles per hour speed limit for trains on this curve and that this curve is known for its danger and for being a very sharp curve. In addition, despite this danger, Positive Train Control devices where not on this northbound portion of the tracks, which would have prevented this tragedy. For reasons that Amtrak either will not explain or can not explain, Positive Train Control devices where on the southbound portion of the Frankford Junction which was the opposite portion of where this derailment occurred.
Seeking Justice and Answers;
Although no amount of money can bring back the lives of those lost or fully compensate those who have suffered such severe orthopedic and neurological injuries, we believe that justice demands that Amtrak be made to pay for what they have caused. We also believe that Amtrak needs to produce more information as to what went wrong and that this absurd two hundred million dollar cap that the US Congress passed years ago to minimize Amtrak's liability and financial exposure needs to be removed.
